New vs Old Tax Regime 2026-27: Which Saves You More?

For FY 2026-27 (AY 2027-28), the Income Tax Department of India continues to offer two regimes to salaried individuals — the New Tax Regime (default) and the Old Tax Regime. Choosing the wrong one can cost you anywhere from ₹20,000 to ₹1,50,000 extra every year. This calculator compares both regimes instantly using the latest FY 2026-27 slab rates, standard deduction, and Section 87A rebate.

The New Regime now offers significantly wider slabs — 0% up to ₹4 lakh, 5% up to ₹8 lakh, 10% up to ₹12 lakh, and so on. Combined with the enhanced ₹75,000 standard deduction and Section 87A rebate, salaried employees earning up to ₹12.75 lakh pay zero tax. The Old Regime retains higher slab rates but allows deductions under Section 80C, 80D, 80CCD(1B), and HRA exemption.

The real power of the Old Regime lies in its deductions:

  • Section 80C: Up to ₹1,50,000 for EPF, PPF, ELSS, LIC, home loan principal
  • Section 80D: Up to ₹25,000 for self and family + ₹50,000 for senior parents
  • Section 80CCD(1B): Extra ₹50,000 for NPS Tier-1 contribution
  • Section 10(13A): HRA exemption — least of (actual HRA, rent minus 10% basic, 50% of basic in metros)
  • Section 24(b): Home loan interest up to ₹2,00,000

Break-Even Deduction Threshold FY 2026-27

Section 87A Rebate: Zero Tax Up to ₹12 Lakh

One of the most powerful provisions for FY 2026-27 is the enhanced Section 87A rebate. Under the New Tax Regime, salaried individuals with net taxable income up to ₹12,00,000 pay zero income tax. When you add the ₹75,000 standard deduction, this means salaried employees earning up to ₹12,75,000 CTC pay zero tax.

Additionally, marginal relief protects you if your income slightly exceeds ₹12 lakh — your tax is capped at the amount exceeding ₹12 lakh, preventing any sudden spike in liability. For example, at ₹12,10,000 income, your tax is capped at ₹10,000 instead of around ₹61,500.

How In-Hand Salary Is Calculated from CTC

Many employees confuse CTC with in-hand salary. In reality, monthly in-hand salary is much lower because several components are deducted:

  • Employee EPF: 12% of basic salary (typically 40% of CTC)
  • Professional Tax: ₹200 per month, state-specific
  • Income Tax (TDS): Monthly deduction based on your chosen tax regime
  • Employer EPF and Gratuity: Part of CTC but not paid in hand monthly

For example, on a ₹12,00,000 CTC, the monthly in-hand is typically around ₹73,000 to ₹75,000 depending on your tax regime and EPF contribution. Our calculator above shows you the exact figure for your inputs.

Real Example: ₹12 Lakh Salary Tax Calculation

New Tax Regime (Default)

  • Gross CTC: ₹12,00,000
  • Less: Standard Deduction: ₹75,000
  • Net Taxable Income: ₹11,25,000
  • Tax: 0–4L (Nil) + 4–8L (₹20,000) + 8–11.25L (₹32,500) = ₹52,500
  • Add 4% Cess: ₹2,100
  • Total Tax: ₹54,600

Old Tax Regime (with ₹3.45 L Deductions)

  • Gross CTC: ₹12,00,000
  • Less: Standard Deduction: ₹50,000
  • Less: Section 80C: ₹1,50,000
  • Less: HRA Exemption: ₹1,20,000
  • Less: Section 80D: ₹25,000
  • Net Taxable: ₹8,55,000
  • Tax: 0–2.5L (Nil) + 2.5–5L (₹12,500) + 5–8.55L (₹71,000) = ₹83,500
  • Add 4% Cess: ₹3,340
  • Total Tax: ₹86,840
Verdict

For ₹12 lakh CTC with ₹3.45 lakh deductions, the New Regime saves ₹32,240 because the FY 2026-27 New Regime slabs are wider than the Old Regime benefits at this income level.

Which Regime Should You Choose?

  • Choose New Regime if: Total deductions below ₹3.75 lakh; no home loan; prefer monthly liquidity; want simple, paperless filing
  • Choose Old Regime if: Metro-city HRA above ₹2 lakh per year; home loan interest above ₹1.5 lakh; total 80C + NPS + 80D crosses ₹2 lakh; income above ₹25 lakh
  • Salaried employees: Switch between regimes every financial year at ITR filing
  • Business owners: Switch only once from New to Old — choose carefully

Frequently Asked Questions

Can I switch between Old and New Tax Regime every year?

Yes. Salaried employees without business income can freely switch between Old and New Tax Regimes every financial year when filing their Income Tax Return. However, business owners and professionals can switch only once from New to Old Regime.

Is Section 80C available in the New Tax Regime for FY 2026-27?

No. Deductions under Chapter VI-A such as Section 80C (PPF, ELSS, EPF), Section 80D (health insurance), Section 80CCD(1B) (NPS), and HRA exemption under Section 10(13A) are not allowed under the New Regime. Only the ₹75,000 standard deduction and employer NPS contribution under Section 80CCD(2) are permitted.

What is the standard deduction for salaried employees in FY 2026-27?

₹75,000 flat under the New Tax Regime and ₹50,000 under the Old Tax Regime. The higher standard deduction in the New Regime is designed to simplify tax filing without requiring investment proofs.

Up to what income is tax zero under the New Regime in 2026-27?

With the ₹75,000 standard deduction and the enhanced Section 87A rebate, salaried individuals earning up to ₹12,75,000 CTC pay zero tax under the New Regime. Marginal relief protects slightly higher incomes from sudden tax spikes.

How is HRA exemption calculated in the Old Regime?

HRA exemption under Section 10(13A) is the lowest of three amounts: (a) actual HRA received, (b) rent paid minus 10% of basic salary, (c) 50% of basic salary for metro cities or 40% for non-metro cities.

What is the break-even deduction for Old vs New Regime in 2026-27?

For CTC above ₹15 lakh, the break-even threshold is approximately ₹3.75 lakh in total deductions. If your total deductions exceed ₹3.75 lakh, the Old Regime typically results in lower tax. Below that, the New Regime usually wins.

Does the New Regime allow any deductions at all?

Yes. The New Regime allows the ₹75,000 standard deduction, employer NPS contribution under Section 80CCD(2), and a few specified allowances. Most Chapter VI-A deductions are not available.

How do I calculate my monthly in-hand salary from CTC?

Monthly in-hand salary = (CTC − Employee EPF − Professional Tax − Annual Income Tax) ÷ 12. Employee EPF is 12% of basic salary (typically 40% of CTC). Professional tax is around ₹200 per month.

What is the effective tax-free income in FY 2026-27?

Under the New Regime, effective tax-free income is ₹12,75,000 for salaried individuals (₹12 lakh taxable income plus ₹75,000 standard deduction). Under the Old Regime, it depends on your deductions.

Is this calculator updated for the latest FY 2026-27 slabs?

Yes. This calculator uses the latest FY 2026-27 slab rates, ₹75,000 standard deduction, enhanced Section 87A rebate up to ₹12 lakh taxable income, marginal relief, and 4% cess as per the latest Union Budget provisions.

Illustrative calculation. Actual tax and in-hand may vary with variable pay, bonuses, state professional tax, and employer policies. Confirm with a qualified CA before filing.

Freelance Tax Calculator for Upwork Earnings in India (New Regime 2026)

Earning in dollars from Upwork feels great until tax season. The good news is that if you live in India, your Upwork income is taxable in India, but you may be able to declare only 50% of your gross receipts as taxable profit under Section 44ADA. This freelance tax calculator for Upwork earnings uses the new regime slabs for FY 2026-27 and shows your estimated tax, TDS credit, and GST status in seconds.

Most freelancers only look at the bank credit and forget that tax is calculated on the INR value of the gross receipt, not on what finally reaches their account after platform fees and currency conversion. This tool keeps the math simple so you can plan your cash flow and avoid last-minute surprises.

Who Can Use Section 44ADA for Upwork Income?

Section 44ADA is a presumptive taxation scheme for specified professionals. The list includes IT and software professionals, engineers, doctors, lawyers, chartered accountants, technical consultants, interior decorators, film artists, company secretaries, and other notified professions. If your Upwork work is software development, IT consulting, engineering design, or similar professional services, 44ADA usually fits.

If you are a content writer, graphic designer, or social media manager, 44ADA may not apply unless your work falls under a notified profession. In that case, Section 44AD may apply if you are running a business. Eligibility depends on your facts, so confirm with a chartered accountant before filing.

The gross receipts limit is ₹50 lakh. It becomes ₹75 lakh if at least 95% of your receipts come through banking or digital channels and cash receipts are 5% or less. Upwork payouts are digital, so most eligible freelancers can use the ₹75 lakh limit. Under 44ADA, you declare 50% of gross receipts as taxable income and you do not have to maintain detailed books of account.

Important Note

Section 44ADA is not available to every freelancer. It is limited to specified professions. If you are unsure, use the calculator to compare 44ADA, 44AD, and actual expenses, then speak to a CA before choosing a method.

New Regime Tax Slabs for FY 2026-27

The new regime slabs for FY 2026-27 are unchanged from the previous year. Here is the table:

Taxable IncomeTax Rate
Up to ₹4,00,000Nil
₹4,00,001 – ₹8,00,0005%
₹8,00,001 – ₹12,00,00010%
₹12,00,001 – ₹16,00,00015%
₹16,00,001 – ₹20,00,00020%
₹20,00,001 – ₹24,00,00025%
Above ₹24,00,00030%

The Section 87A rebate makes tax nil if your taxable income is up to ₹12 lakh. If your taxable income is slightly above ₹12 lakh, marginal relief applies so that the tax does not exceed the income above ₹12 lakh. A 4% health and education cess is added to the tax and surcharge.

Freelancers do not get the salaried standard deduction of ₹75,000. They also cannot claim Chapter VI-A deductions like 80C, 80D, or 80TTA under the new regime. The main benefit comes from the presumptive 50% or 6% deemed profit, not from deductions.

How to Calculate Tax on Upwork Earnings

The calculation follows a fixed sequence:

Gross Receipts (INR) = USD earnings × exchange rate

Taxable Income (44ADA) = Gross Receipts × 50%
Taxable Income (44AD) = Gross Receipts × 6%
Taxable Income (Actual) = Gross Receipts − Expenses

Tax = Slab rates on taxable income
Rebate u/s 87A if taxable income ≤ ₹12,00,000
Cess = 4% of (tax + surcharge)
Net Tax = Tax + Cess − TDS credit

Maan lijiye aapne FY 2026-27 me ₹30 lakh Upwork se kamaye aur aap 44ADA ke eligible hain. Taxable income ₹15 lakh hogi. New regime me tax before rebate ₹1,05,000 banta hai. Rebate nil hai kyunki income ₹12 lakh se zyada hai. 4% cess ₹4,200 hai, so total tax ₹1,09,200. Gross receipts ke hisaab se effective rate sirf 3.6% hai.

Ab agar aapne ₹20 lakh kamaye aur 44ADA use kiya, taxable income ₹10 lakh hogi. Tax before rebate ₹40,000 hai, lekin Section 87A rebate ke baad tax zero ho jata hai. Iska matlab hai ki ₹20 lakh tak ki eligible freelance income par zero income tax ho sakta hai, agar koi doosri income nahi hai.

TDS on Upwork and Foreign Client Payments

Foreign clients generally do not deduct Indian TDS. Upwork also does not deduct Indian TDS on your payouts. Indian clients may deduct 10% TDS under Section 194J for professional fees or 1%–2% under Section 194C for contract work. TDS is not an extra tax. It is tax already paid on your behalf, and you claim credit for it in your ITR.

If TDS has been deducted, check Form 26AS and AIS before filing. The credit should match the TDS shown by your clients. If your income is below the taxable limit but TDS was deducted, still file your ITR to claim a refund.

Practical Tip

Keep a simple ledger of every Upwork withdrawal, the exchange rate used, platform fees, and TDS. This makes it much easier to reconcile your ITR with Form 26AS and AIS at the end of the year.

GST on Upwork Earnings: ₹20 Lakh Threshold and LUT

GST registration becomes mandatory once your aggregate turnover crosses ₹20 lakh in a financial year. In special category states, the threshold is ₹10 lakh. Foreign income counts towards this threshold, so even a fully export-based freelancer must register after crossing ₹20 lakh.

Export of services is zero-rated. After registration, file a Letter of Undertaking (LUT) in Form GST RFD-11. With an LUT, you can export services without paying IGST. Without an LUT, you may have to pay 18% IGST and then claim a refund, which blocks your working capital.

If you serve domestic clients, your invoices attract 18% GST after registration. If you serve only foreign clients and your turnover is below ₹20 lakh, GST registration is generally not required. You can still register voluntarily if you want to claim input tax credit on business expenses.

Common Tax Mistakes Freelancers Make

  • Using the wrong exchange rate. Convert each receipt at the SBI TT buying rate or RBI reference rate on the date of receipt. Do not use one annual average rate for everything.
  • Ignoring TDS credit. Many freelancers pay tax again because they forget to claim TDS already deducted by Indian clients.
  • Assuming GST does not apply because clients are foreign. Foreign income counts towards the ₹20 lakh GST threshold. Export is zero-rated, but registration and LUT may still be required.
  • Using 44ADA without checking eligibility. Content writers and designers may not fall under specified professions. Using the wrong section can lead to notices.
  • Not paying advance tax. A large tax bill at filing time is avoidable if you pay advance tax during the year.
  • Not filing ITR when tax is zero. If TDS was deducted, filing is the only way to claim a refund. Filing also creates a clean income record for loans and visas.

Frequently Asked Questions (FAQs)

Is Upwork income taxable in India?
Yes. If you are a resident of India, your global income is taxable in India, including freelance earnings from Upwork. You must report the INR value of your gross receipts in your ITR.
Can I use Section 44ADA for Upwork income?
Section 44ADA applies only to specified professions such as IT, software development, engineering, legal, medical, accountancy, technical consultancy, and interior decoration. Gross receipts must be within ₹50 lakh, or ₹75 lakh if at least 95% of receipts are digital. Confirm your eligibility with a CA.
How much tax do I pay on ₹20 lakh Upwork income in India?
Under Section 44ADA, taxable income is 50% of ₹20 lakh = ₹10 lakh. Under the new regime for FY 2026-27, tax on ₹10 lakh is ₹40,000, but the Section 87A rebate reduces it to zero because taxable income is up to ₹12 lakh. Cess is also nil after rebate. This assumes no other income.
Do foreign clients deduct TDS on Upwork payments?
Foreign clients and Upwork generally do not deduct Indian TDS. Indian clients may deduct 10% under Section 194J for professional fees or 1%–2% under Section 194C for contract work. TDS is not extra tax; you claim credit in your ITR.
Do I need GST registration for Upwork earnings?
GST registration is required once aggregate turnover crosses ₹20 lakh in a financial year (₹10 lakh in special category states). Foreign income counts towards this threshold. Export of services is zero-rated, but after registration you should file a Letter of Undertaking (LUT) to export without paying IGST.
