Understanding TDS on Rent - Sections 194-IB vs 194-I

Under the Income Tax Act, 1961, tenants must deduct TDS (Tax Deducted at Source) on rent payments. The applicable section depends on who is paying the rent and how much rent is being paid. Getting this wrong can lead to penalties up to ₹10,000 under Section 271H, plus interest under Section 201(1A).

Section 194-IB: For Individuals & HUF (Not Subject to Tax Audit)

This section applies when an individual or HUF (not required to get accounts audited) pays rent exceeding ₹50,000 per month for land, building, or furniture.

  • TDS Rate: 5% of the rent (2% if landlord has no PAN - actually 20% u/s 206AA)
  • Threshold: ₹50,000 per month (₹6,00,000 per year)

Do I need to deduct TDS if my rent is ₹45,000/month?

No. Under Section 194-IB, TDS is only required if monthly rent exceeds ₹50,000. At ₹45,000/month, you're below the threshold. However, if you're a business (Section 194-I), the annual threshold is ₹2,40,000 - so ₹45,000 × 12 = ₹5,40,000 would attract TDS.

What if I'm paying rent to my parents?

TDS rules apply regardless of relationship. If you're paying rent to parents exceeding ₹50,000/month (as individual) or ₹2,40,000/year (as business), TDS must be deducted.
